"The intent of this project is not to present convincing arguments either for or against capital punishment. Rather, it will work towards deepening the reader's understanding of modern America's system of capital punishment. It will present the American death penalty system in the context of international jurisdictions and in so doing illustrate the nation's odd stance on the international stage. The project will explore those key Supreme Court decisions of the last 75 years that have shaped the system into what it is today. The paper will fully investigate the United State's unique state-by-state structure of the death penalty -- a result of America's federalist system of dual government -- and seek to understand why and how different jurisdictions within one nation arrive at such very different judicial decisions and processes. In the end, it is the intent of this project to empower the reader with knowledge of their nation's harshest system of punishment so that they can move towards a command of the facts and a more informed position"--Leaves 1-2.
