    Drawing together the work of ten leading playwrights - a mixture of established and emerging writers - this National Theatre Connections anthology is published to coincide with the 2014 festival, which takes place across the UK and finishes up at the National Theatre in London. It offers young performers between the ages of thirteen and nineteen everywhere an engaging selection of plays to perform, read or study. Each play is specifically commissioned by the National Theatre's literary department with the young performer in mind. The plays are performed by approximately 200 schools and youth theatre companies across the UK and Ireland, in partnership with multiple professional regional theatres where the works are showcased. As with previous anthologies, the volume will feature an introduction by Anthony Banks, Associate Director of the National Theatre Discover Programme, and each play includes notes from the writer and director addressing the themes and ideas behind the play, as well as production notes and exercises. The National Theatre Connections series has been running for nineteen years and the anthology that accompanies it, published for the last three years by Methuen Drama, is gaining a greater profile by the year. Some iconic plays have grown out of the Connections programme including Citizenship by Mark Ravenhill, Burn by Deborah Gearing, Chatroom by Enda Walsh, Baby Girl by Roy Williams, DNA by Dennis Kelly, and The Miracle by Lin Coghlan. The series has a recognisable brand and the anthologies continue to be an extremely useful resource, their value extending well beyond their year of publication. This year's anthology includes plays by Sabrina Mahfouz, Simon Vinnicombe, Catherine Johnson, Pauline McLynn, Dafydd James, Luke Norris and Sam Holcroft.

Luke Norris's play Growth was first produced by Paines Plough in their pop-up theatre, Roundabout, at the 2016 Edinburgh Festival Fringe, where it won a Fringe First Award. It subsequently toured the UK. An earlier version of the play was seen at the Gate Theatre, London.

    A series of changes within civil procedure over the past few decades--including the rise of private arbitration, the accompanying decline of public adjudication, and the erection of barriers to class actions--have diminished the economic power of workers, consumers, and diffuse economic actors. This Article demonstrates that avoiding these economic consequences was a central goal of those who crafted American federal civil procedure in the first place. Driven to action by the procedural issues involved in labor injunction cases, leading procedural reformers behind the modern regime strove to make American federal civil procedure sensitive to questions of political economy and designed it to mitigate rather than reflect economic power imbalances. This Article connects their procedural reform efforts in the enactment of the Norris-LaGuardia Act of 1932 to the rise of the Federal Rules of Civil Procedure of 1938, and, in so doing, reveals the unexplored progressive economic foundations of federal civil procedure.This history provides a platform for a more conceptual analysis about civil procedure and economic power. The Article embeds the Norris-LaGuardia Act's procedural provisions in the rise of the federal government's facilitation of the “countervailing power” of workers, and begins to articulate the procedural dimensions of economic empowerment. While countervailing power is typically thought of as being facilitated by substantive law, the Norris-LaGuardia Act demonstrates how civil procedure can facilitate the exercise of countervailing power by providing economically less-resourced parties with open hearings and structuring procedure to protect their ability to amass power through association. More broadly, and returning to present issues, this Article argues that the recent transformations in civil procedure both undermine the economic purposes that were central to the regime's rise and diminish the ability of diffuse economic actors to exercise countervailing power--threatening once-enduring procedural commitments.

    This Article argues that the conventional narrative about the decline of Lochnerism and the rise of mid-century substantive due process jurisprudence is incomplete. That narrative focuses initially on how the premises underlying Lochner's conception of economic freedom were rejected. The Article instead focuses on how the labor movement articulated an alternative conception of freedom that was adopted by Congress, the Executive, and the Supreme Court. While Lochnerism was premised on a negative view of freedom, the labor movement articulated a positive view of freedom and analogized it to republican freedom of association in the political sphere. By reframing the terms of the Lochner-labor debate, the Article shows how strands of labor's conception of associational freedom in one nominally private sphere -- the workplace -- are transported into modern substantive due process jurisprudence in the post-Griswold era as the doctrine protects association in another -- the intimate sphere. The Article traces similarities between the rise of labor's freedom and the rise of sexual and intimate freedoms and explores the ways in which they have transformed American constitutional law.

    The Supreme Court has interpreted the Federal Arbitration Act of 1925 (FAA) in a broad way that has allowed firms to widely privatize disputes with workers and consumers. The resulting expansive growth of American arbitration law has left commentators both concerned about the structural inequalities that permeate the regime and in search of an effective limiting principle. This Article develops such a limiting principle from the text and history of the FAA itself. The Article reinterprets the text and history of section 1 of the statute, which, correctly read, excludes individual employee-employer disputes from the statute's coverage. The Article argues that section 1, though targeted at employees, is based on a parity principle that holds that the state has reason to regulate and limit the enforcement of arbitration agreements where deep economic power imbalances exist between the parties -- that is, where relative parity is lacking. The parity principle underlying section 1 can best be understood through the lens of Progressive-Era thought at the time of the FAA's enactment that focused on the regulatory responsibility of the state, through public adjudication and legislation subject to judicial interpretation, to publicly oversee the resolution of disputes and distribution of rights between parties of highly disparate economic power. This Article develops the logic and theory of the parity principle, and explores its implications for how courts should interpret the FAA and for legislative and administrative reforms targeted at workers and consumers.
